EU Rule of Law Case-Law: Crucial Recent Developments

the second re:constitution Seminar will take place on 4 June in cooperation with RECONNECT and CEU Democracy Institute’s Rule of Law Working Group

The framework for the seminar is the latest publication by Dimitry Kochenov, Lead Researcher of the Rule of Law Workgroup at CEU Democracy Institute and Laurent Pech, Senior Research Fellow at CEU Democracy Institute: „Respect for the Rule of Law in the Case Law of the European Court of Justice: A Casebook Overview of Key Judgments since the Portuguese Judges Case“.

The European Court of Justice is behind a recent and genuine enhancement of European constitutionalism, placing the rule of law, a long-established value and principle of EU law, at the center stage. This rule of law-enhancing process of re-articulation of EU constitutionalism is ongoing and represents the Court of Justice’s incrementalist response to the process of rule of law backsliding which first emerged in Hungary before spreading to Poland.

 

This event aims to present and critically analyze this judicial response on a case-by-case basis taking the Court’s judgment in Case C-64/16, ASJP (Portuguese Judges) as a departure point and its judgment in Case C-896/19, Repubblika (Maltese Judges) as a provisional end point.

We will start the seminar with a public event that can be followed live on Facebook. The debate will be chaired by Petra Bárd, Researcher at CEU’s Legal Studies Department. Next to Dimitry Kochenov and Laurent Pech, the authors of the Case Law Study, Barbara Grabowska-Moroz, Research Fellow at CEU Democracy Institute, will join the panel with her expertise.

The public event will be followed by a closed session with the re:constitution Fellows, convened by Dimitry Kochenov and Laurent Pech for an in-depth discussion of the study results.
