The rule of law has distinct common characteristics in Europe and is not just a political slogan - as it has been claimed in the context of ongoing rule of law backsliding in the European Union. Though its detailed requirements may vary, core elements of the rule of law are the same in all European member states. With our seminar on ‘Rule of Law Methodologies’ we are devoting an entire event to discussing the exact meaning and clarifying the layers of understanding of the rule of law. Three core questions will be addressed:
1. Thin or thick? The importance of defining the rule of law
2. Measuring the rule of law – How to do it?
3. A Case Study: The Promises of the Conditionality Regulation
This seminar is organised in collaboration with re:constitution patron Angelika Nußberger and the Academy for European Human Rights Protection, University of Cologne and is a hybrid event on the premises of the Fritz Thyssen Stiftung.
A public keynote by Adam Bodnar, SWPS University of Social Sciences and Humanities and former Ombudsman of the Republic of Poland will focus on the practical aspects of rule of law backsliding: “The Court of Justice of the European Union and the European Court of Human Rights as a sword and a shield for Polish judges”.
