Protecting EU Values in the Member States in 2026: At a Turning Point?

Hybrid event organised by re:constitution alumni as part of the Incubator Fund 2026

University of Palermo, Law Department, Aula Circolare

A workshop poster aimed at promoting our alumni Incubator Fund Project for 2026

On 22 October 2026 re:constitution Alumni Francesco Gatta and Matteo Bonelli organize a hybrid workshop at the University of Palermo (Università degli Studi di Palermo).

This workshop aims to take stock of latest developments in the protection of EU values and to contribute to an updated assessment of the state of the art. It will address two central questions: Where do we stand in terms of the protection of EU values in Member States in 2026? Are we at a turning point, and if so, where is this shift leading us?

In cooperation with fellow researchers our Alumni Francesco and Matteo strive to understand how the central events of 2026 are influencing, and possibly re-shaping, the landscape of European constitutional backsliding, and the EU’s reaction to it.

2026 has been a crucial year for the European constitutional backsliding crisis. In April, Hungary held landmark elections that brought an end to Viktor Orbán's time in office, following years of deteriorating rule of law standards, democratic institutions and fundamental human rights guarantees.

The new government, led by Prime Minister Péter Magyar, has raised expectations of democratic recovery, often referred to as, “democratic frontsliding”. However, as Poland's ongoing experience illustrates, reversing institutional deterioration is a complex and lengthy process.

Another turning point came on 21 April 2026, when the Court of Justice of the European Union (CJEU) delivered its judgement in Commission v. Hungary (C-769/22). In a significant ruling concerning Hungary's 2021 "child protection law", the CJEU found, for the first time in an infringement action against a Member State, a breach of Article 2 of the Treaty on European Union (TEU), which enshrines EU's foundational values. CJEU's ruling addressed the legislation that restricted access to content depicting LGBTQ+ identities and relationships, finding that the measures violated EU law and fundamental rights.

Furthermore, the negotiations for the new Multiannual Financial Framework (2028-2035) provide opportunities to expand mechanisms of conditionality linked to the protection of EU values.

Against this backdrop, this workshop will provide an opportunity to reflect on whether these developments signal a lasting shift in the protection of EU values and what challenges lie ahead for the EU and its Member States.
